Welcome to Eclipse Racing! We have created a website that ensures that you enjoy a secure and hassle free shopping experience. When purchasing on-line with us, you agree to the following terms and conditions of sale. Please read them carefully.

Consumer Law

Eclipse Racing Limited undertakes to meet all of our obligations under the consumer laws currently in force. For more details, please visit the Department of Trade and Industry at www.dti.gov.uk or the Office of Fair Trading at www.oft.gov.uk All Terms and Conditions as detailed here shall be construed and operate in conformity with English and Welsh law.

Acceptance of the Order

Once you place an order to purchase a product from www.eclipseracing.co.uk, we will send you a Confirmation Email confirming the receipt of your order and the order details. Your order represents an offer to purchase a product from us. This offer is accepted by us when we send e-mail confirmation in the form of the Completion Email to you confirming that we have dispatched the products ordered to you. No contract/agreement with Eclipse Racing Ltd will exist until the Completion Email has been received and your order has been dispatched. Should the item that you have ordered be out of stock or have become unavailable, we will contact you as soon as possible to notify you of the situation. We will also refund any monies deducted from your credit card. Should some of the items that you have ordered be out of stock or have become unavailable while part of your order is in stock or available, we will contact you as soon as possible to notify you of the situation. We will also refund any monies deducted from your credit card for the items that are out of stock or have become unavailable. Any products on the same order which we have not confirmed in the Completion E-mail and dispatched, do not form part of that contract.

Typographical and Pricing Errors

In the event a product or service is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we shall have the right to refuse to meet or to cancel any orders placed for that product or service whether or not the order has been accepted and your debit or credit card charged. If your debit or credit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to your debit or credit card account in the amount of the charge and Eclipse Racing's liability to you will come thereafter come to an end. No contract shall exist between yourself and Eclipse Racing Ltd until the Completion E-mail is received notifying you that your goods have been dispatched. Eclipse Racing shall then e-mail you to ask whether you are willing to pay the correct price for the goods or services ordered.

Delivery

Delivery will normally take place within 3 - 10 working days. In the event that an order takes longer than 10 days to dispatch, we will notify you and let you know when to expect delivery.

Delivery will be sent to the address provided by you at the time of ordering. Eclipse Racing Ltd will not be held responsible for any difficulties that may arise with a delivery as a result of incorrect delivery details being supplied at the time of ordering, if no notification of a change in the delivery address was received prior to dispatch. Payment

Home Customers

All prices are quoted in Pound Sterling and include VAT. Payment can be made by credit/debit card. We accept Visa, Mastercard, Delta, Solo, Switch, Maestro, Visa Electron, Eurocard and American Express.

Industrial/Commercial Customers

All prices are quoted in Pound sterling and exclude VAT. VAT invoices will be sent with the delivery.

Refunds

Refunds will be made for all orders cancelled within 7 days of ordering or for items returned within 7 days of delivery. All goods returned for refund, must be returned in the original box and in perfect condition to Eclipse Racing Limited by insured post at the senders expense. A restocking fee of up to 25% is charged on all returns, which prove to be non defective.

Full refunds will be made if the product ordered is faulty or if the product that is delivered differs from the one that was ordered. If the item was faulty, Eclipse Racing will refund all postage costs.

Claims for damage and mis-shipping must be made within 7 days of receipt of the product. After this period, and in all circumstances after 14 days, repair and not replacement will be offered.

No opened software will be accepted for refund. Faulty discs will be swapped by the manufacturer.

Goods are not sold on a trial basis, unless explicitly stated otherwise.

We are not responsible for any consequential loss or expenses, however caused, including incidental returns cost.

Cancellations

All cancellations must be made in writing, either by email, fax or letter within 24 hours of ordering. If a cancellation is not received within 24 hours of ordering, the product may be returned unopened and in its original packaging within 7 days for a full refund. Please refer to our refund conditions for more detailed information on our refund policy and the restocking fee.

Complaints

If you are in any way dissatisfied with the quality of the product or the service that you have received, please email sales@eclipseracing.co.uk with Complaint in the subject line and your complaint details. We will resolve the issue in accordance with our complaints procedure. For full details of our complaints procedure, please email sales@eclipseracing.co.uk. In the event of a dispute arising, the matter will be settled by an independent arbitrator appointed by Eclipse Racing Limited.

Security

Your security is important to us. Our website uses an encrypted and secure server for all its payment operations, which ensure that your personal information and transactions cannot be tampered with. In the event of unauthorised use of your credit or debit card, most banks and card issuers will either cover all the charges that result from the fraudulent use of your card or they might limit your liability to 50. If you have any concerns about the level of security used by Eclipse Racing Limited, please email sales@eclipseracing.co.uk and we will happily answer any queries that you may have.

General

We do not warrant the suitability of goods for a particular purpose, and you should check suitability and specifications with the manufacturer before ordering.

All goods remain the property of Eclipse Racing Limited until they have been paid for in full.

Prices and manufacturers specifications are subject to change without notice. Minor specification changes will not entitle the purchaser to rescind the contract.

If part of these terms is found to be unlawful, it will not affect the validity of the remainder.

This web site is intended for viewing by users situated in the United Kingdom. Eclipse Racing shall not be liable if the content of this web site or any viewing of it by you is contrary to the laws applying in the place where you access this web site.

Eclipse Racing does not make this web site available for your specific needs. Eclipse Racing is not liable for the accuracy, availability, completeness or usefulness of any of the information accessible on or via this web site or whether the information is up to date.
